New federal expungement filing raises stakes for DOJ

Not surprisingly, in the wake of U.S. District Judge John Gleeson’s extraordinary May 21 expungement order in Doe v. U.S., another petition asking for the same relief has now been filed with Judge Gleeson.  Also not surprisingly, since this new petition was filed by one of Ms. Doe’s co-defendants, the underlying facts in this second petition are similar. The second Jane Doe was a more culpable participant in the insurance fraud scheme, and was sentenced to 15 months in prison instead of probation.*  However, she has remained law-abiding since her release more than a decade ago, and like the first Jane Doe she has had a very difficult time getting or keeping a job because of her conviction.  It seems unlikely that the difference in the second Jane Doe’s role in the offense will make a difference in the way the court disposes of her petition.

Judge Gleeson has asked the government to show cause why the new petition should not be granted, which should guarantee that it gets attention at the highest levels of the Justice Department.  Argument has been set for September 18.  If there were any doubt about whether the government will prosecute its appeal of the first expungement order, it has probably been dispelled now that the proverbial floodgates appear to be opening. Potential amici should start lining up counsel.

DOJ on the fence about appealing federal judge’s expungement order

On June 23, the U.S. Attorney wrote to Judge Gleeson informing him that the government had not yet finally decided whether to appeal his May 21 expungement order in Doe v. United States, and requesting an opportunity to address the scope of the order in the event the appeal is withdrawn.  The government’s letter, reproduced in its entirety below, indicates that the government has been discussing with the FBI how the order might be modified to “effectuate the Court’s intention of precluding the petitioner’s prospective employers from learning of her health care fraud conviction” while also allowing the government “to pursue legitimate law enforcement objectives.”  Those objectives appear to relate to the arrest and prosecution of two of Ms. Doe’s codefendants who remain in fugitive status after more than a decade.  On June 24, in an order granting the government’s request, Judge Gleeson suggested that the government bring any concerns about the scope of the order to the court’s attention even while the appeal is pending.

Lawsuit challenges Pennsylvania bar to nursing home employment

An effective NPR piece tells the story of Tyrone Peake, a Pennsylvania man whose 1981 conviction for attempted theft barred him from employment as a caregiver in a nursing home, despite training and certification that qualified him for the job.  The state law making people with a felony record absolutely ineligible for employment in any health care facility in the state was was held unconstitutional by the Pennsylvania Supreme Court 15 years ago on equal protection grounds.  However, it remains on the books and enforced despite repeated rulings by lower courts invalidating it in particular cases.  Now another lawsuit has been filed, with Mr. Peake as one of the plaintiffs, that seeks to put an end to this broad and unfair collateral sanction once and for all.  The lawsuit is described in the following article from the website of Community Legal Services of Philadelphia, one of the law’s challengers.   Read more

Federal judge expunges conviction to avoid collateral consequences

In what appears to be an unprecedented action (at least if it stands), a federal judge has expunged the concededly valid conviction of a woman he sentenced 13 years before, whose difficulties in finding and keeping employment evidently moved him to take extraordinary measures.  In Doe v. United States, Judge John Gleeson (EDNY) commented on the “excessive and counterproductive” employment consequences of old convictions:

Doe’s criminal record has prevented her from working, paying taxes, and caring for her family, and it poses a constant threat to her ability to remain a law-abiding member of society. It has forced her to rely on public assistance when she has the desire and the ability to work. Nearly two decades have passed since her minor, nonviolent offense. There is no justification for continuing to impose this disability on her. I sentenced her to five years of probation supervision, not to a lifetime of unemployment.

Professional careers jeopardized by old charges

A local office of the Wisconsin State Public Defender recently assisted two former clients who encountered obstacles with their respective legal and medical careers (minor details have been changed to ensure client confidentiality).  These examples show that old criminal cases, even for relatively minor charges, can cause employment difficulties and frustrate professional advancement many years later.

The first former client recently passed an out-of-state bar examination, and he disclosed on his license application a 20-year-old Wisconsin misdemeanor charge.  When he called for assistance in interpreting the online court records, he learned (to his relief) that what he had always thought was a criminal conviction had actually been reduced to a non-criminal ordinance violation.  Although the original criminal charge remains accessible in Wisconsin’s court records, he was able to amend his license application to report that he does not have any criminal conviction record.  (It is not clear what effect a misdemeanor conviction would have had on his licensure, but now he won’t have to find out.) 1. Access to Greek Criminal Records 

In Greece, a criminal record is created for every adult[2] person who has been irrevocably convicted of a misdemeanor or a felony (i.e. by a decision not subject to an appeal before the Supreme Court). Unlike in the U.S. but consistent with continental European countries, a Greek criminal record does not contain arrest information. Individual criminal history records are considered “sensitive personal data.” Disclosure and access is restricted to protect the convicted person’s privacy and to promote rehabilitation. Although Greek court proceedings are open to the public, court records are not available for public inspection.

Vermont becomes the 16th state to ban the box!

On April 22 Vermont became the 16th state to remove the question about criminal record from most state employment applications.   By Executive Order of Governor Peter Shumlin, people applying for most state jobs will not be required to undergo a background check until after they have been deemed qualified and offered an interview180px-Coat_of_arms_of_Vermont.svg.      

“When we hire in-state, the first question will not be whether you’ve been convicted or arrested,” Shumlin said. “We will hold that question until the interview and give you a chance to qualify for the job for which you’ve applied.”

About 8 percent of people seeking Vermont state jobs checked the criminal history box last year, according to the state Human Resources Commission.   Certain sensitive and law enforcement positions are excepted.

Increase in Delaware pardons “driven by getting jobs”

imagesbluehenDelaware Governor Jack Markell has granted more than 1500 pardons in his six years in office, substantially more than any of his predecessors.  According  to articles by Chris Barrish and Jonathan Starkey in the Delaware News Journal, the “dramatic increase” in the number of people applying for pardon in Delaware has been “driven by getting jobs.”  In defending his record of generous pardoning, Governor Markell noted that the state had adopted 50 new background check requirements for employment in the past several years, and that people with convictions need a governor’s pardon to enable them to overcome the stigma of conviction to obtain employment and stay on the road to rehabilitation.  The two articles are here and here.

Taking a bite out of Apple’s restrictive hiring policies

Apple, maker of the iPhone and iPad, came under fire earlier this month when the San Francisco Chronicle revealed that the company was prohibiting those convicted of a felony in the last 7 years from working on the construction of an enormous new corporate campus in Cupertino, California.  Under pressure from the iron workers union and advocates for fair hiring policies, the company quickly reversed course:

We recognize that this may have excluded some people who deserve a second chance. We have now removed that restriction and instructed our contractors on the project to evaluate all applicants equally, on a case-by-case basis, as we would for any role at Apple.

But many believe that Apple can do more to end employment discrimination against those with criminal records and can set an example for the tech industry and the country in the process.

Federal fair chance hiring proposal advances

The following note was received today from the National Employment Law Project:

We wanted to report back on the exciting progress in support of the federal fair chance hiring initiative, which builds on the momentum from the sign-on letter to the President that your organizations endorsed.

On March 25th, representatives from NELP, All of Us or None, PICO National Network and the Southern Coalition for Social Justice met with White House and Labor Department officials to present the letter signed by nearly 200 organizations and urge immediate federal action.  The news about the sign-on letter and the White House meeting was covered in an excellent exclusive that appeared in Politico (check it out) the day of the meeting.  The sign-on letter was also featured in an op-ed by a Florida small business owner (and a member of our partners at the Main Street Alliance) in The Guardian, in an NNPA syndicated story picked up by several news outlets, as well as in a National Law Review story.

In addition, thanks to the active engagement of your organizations, the social media around the initiative is also picking up steam. The Facebook image (attached) produced over 60,000 views, and it was shared by nearly 1,000 people.  During the one-hour “tweet storm” on the 25th, there were 250 unique tweets using the #FairChance or #BanTheBox hashtags (a special shout out goes to Danny Glover, whose tweet led the way with most retweets).  In just a few short months, we’re building a serious social media following thanks again to all of you.

Based on the feedback we received at the meetings on the 25th, all the support from your organizations, the press and the social media is getting the Administration’s attention – they have made clear that they are taking a serious look at the proposal to issue an Executive Order and Presidential Memo to extend fair chance hiring/ban the box to federal contractors and the federal hiring process.   Now, it’s all about  continuing to build the grassroots and public pressure to move the Administration to act.  Your continued active involvement is critical to the success of the effort.

On another positive note, we wanted to also share the news that Virginia Governor McAuliffe issued a strong executive order today extending fair chance hiring to all state positions (and urging the private sector to do the same).  McAuliffe’s action got the attention of Valerie Jarrett, President Obama’s Senior Advisor, who tweeted out her support using the #BantheBox hashtag.  Please take minute to retweet it as well.
